Introductory Statement

Three Across, LLC d/b/a PuzzleNation.com (“PuzzleNation”) and other owned or affiliated entities (“We”) have created this Privacy Policy to demonstrate that we respect and will protect your right to privacy while visiting PuzzleNation.com (this “Site”). This Policy discloses the information gathering and dissemination practices for this Site and details the steps taken to protect your privacy during its use.

Why is Personal Information collected?

PuzzleNation collects Personal Information (as defined below) to assist you in subscribing to the Site and to determine that you meet the minimum requirements for membership (see our policy below with respect to minors under 18). In addition, PuzzleNation may collect information to provide an improved service to you by determining your preferences. We will not rent or sell any of the Personal Information we collect from you to third parties. We will not share any of the Personal Information with third parties without your consent, unless such sharing is necessary for purposes set forth in this Privacy Policy or we are required to do so by law.

What is “Personal Information”?

Personal Information is individually identifiable information about a customer or member. This information can include first and last name, billing address, e-mail address or telephone number, debit or credit card number and expiration date and also the individual’s subscriber/account number, IP address or persistent identifier.

How do we protect Personal Information?

PuzzleNation is the sole owner of the information collected on the Site. Your Personal Information can only be collected when you voluntarily provide it. It is our policy and commitment to protect the privacy of your information and to keep it secure by doing the following:


  • Using SSL (Secure Sockets Layer) to provide a secure connection during transmission of debit or credit card information from your Web browser to PuzzleNation. PuzzleNation does not store, except to the extent that it may be stored on our server on a temporary basis, any debit or credit card information. It is stored by our PCI-compliant third party payment processor, Authorize.net.

  • Maintaining appropriate physical, electronic and procedural security safeguards in order to protect your Personal Information wherever it is stored both physically and electronically.

  • Destroying, erasing or making unreadable any data, computer files and documents that may contain your Personal Information prior to their disposal.

  • Protecting the confidentiality of your Personal Information.

  • Prohibiting the unlawful disclosure of your Personal Information.

  • Restricting employee access to databases containing your Personal Information and confidentiality requirements.

  • Training our employees on best practices for protecting the privacy of your Personal Information on a regular and ongoing basis.

  • Restricting subcontractors’ or other third parties’ access to the database containing your Personal Information except in accordance with the terms of this Privacy Policy, and binding subcontractors who have access with contractual, technical and organizational measures to protect your Personal Information.

  • In the event that there is ever a breach of security regarding your Personal Information, we will comply with all applicable state and federal law requirements regarding the notification and disclosure to you and to the appropriate authorities of the circumstances surrounding the breach.

    When is my Personal Information collected?

    PuzzleNation collects your Personal Information under the following conditions:


  • During any purchase you are asked for your full name and billing address, an e-mail address, your debit or credit card number and its expiration date and CVV, and other optional information (see our policy with respect to children under 18).

  • Through cookies: PuzzleNation may set and access cookies on your computer to manage your sign-in status or in-game preferences. Cookies are small lines of text stored with your web browser for record-keeping purposes. These are uniquely assigned to your computer and used to enhance and customize your experience with PuzzleNation. The use of cookies is standard in the Internet industry.

  • Through your IP Address: Your Internet Protocol address is a sequence of numbers unique to your computer and has been assigned to you by your Internet provider. We may use this address to identify your system during diagnosis of problems or irregularities with your access or account.

  • Your Personal Information may be requested for certain contests or promotions, should you choose to participate in them.

  • Who does PuzzleNation share my Personal Information with?

    We do not share your Personal Information with third parties (except with our third-party payment processor or with other parties as necessary to process your order or retain your subscription information) without your permission. You will be able to “Opt In” to share your name and e-mail address with affiliated third parties, via our sign-up for the PuzzleNation mailing list. You may unsubscribe from this mailing list at any time by using the unsubscribe link within any e-mails you receive.

    Credit Card Companies and Third Party Payment Companies

    Your bank or credit card company will receive your Personal Information and relevant information regarding your purchase as it would in any debit or credit card transaction. We will only provide your Personal Information to your bank or credit card company to the extent it is needed to complete payment. As disclosed above, we use a third party payment processor (which is currently Authorize.net) to facilitate your debit and credit card transactions and process your orders. In such cases, we will share your Personal Information, including but not limited to your debit or credit card information, with the third party payment company solely for the purpose of completing the transaction or processing your order. We strive to ensure that any third party payment processor we do business with has its own privacy policy in place and will comply with its policy. We will refuse to do business with any third party payment processor that does not have a privacy policy or who we discover has materially failed to comply with its privacy policies. However, we cannot guarantee the security of your Personal Information once it is transferred by us to a third party payment processor.     Is PuzzleNation for children under 18 years of age?

    PuzzleNation does not knowingly accept orders or collect any information from children (under 13 years of age) or minors (under 18 years of age). To make a purchase on the Site, a customer must have a valid debit or credit card. PuzzleNation assumes that a purchase made with a debit or credit card signifies that the customer is an adult. If PuzzleNation determines that any customer is or may be between the ages of 13 and 18 years old, we shall take all measures we deem necessary to verify that a parent or guardian has authorized and is willing to guarantee payment of the charges to the debit or credit card and has consented to this Privacy Policy as well as the Terms and Conditions of Use (the “Terms and Conditions”) both personally and on behalf of the minor between 13 and 18 years of age. Such measures shall include but are not limited to contacting any parents or guardians of any minor between 13 and 18 years old, by telephone, e-mail or otherwise and requesting any such information required by us to verify their identity, to receive their written authorization and guarantee of payment of the credit card charges and their written consent to this Privacy Policy and the Terms and Conditions on behalf of the minor between 13 and 18 years of age. We shall have the right to suspend or terminate the minor customer’s account until such written authorization and consent has been received in a manner that is satisfactory to us. In no instance shall any child under 13 years of age be allowed to use this Site. If PuzzleNation determines that any customer is or may be under 13 years of age, we shall immediately suspend or terminate that customer’s account unless and until we receive evidence satisfactory to us that the customer is at least 13 years of age (as well as the required written authorization and consent of a parent or guardian if the customer is between 13 and 18 years of age). PuzzleNation respects the rights of privacy for parents and children and is committed to complying with the Children’s Online Privacy Protection Act of 1998 (COPPA).

    Non-USA Members

    We collect, process and maintain your information in the United States, where privacy laws may be different than in your home country. If you are using the Site from a location outside of the United States, by providing your Personal Information, you are agreeing to the terms of this Site as set out in this Privacy Policy and are accepting that your information is being transferred to the United States for processing and maintenance. To the extent that any competent authority in your home country determines that the protections afforded by this Privacy Policy are not adequate or are not in compliance with the laws of your home country, you agree to immediately discontinue your use of this Site.

    Using the Site “Tell a Friend” Link

    If you choose to use our “Tell A Friend” link to refer PuzzleNation to a friend, we will ask you for your friend’s e-mail address. We will send your friend an e-mail on your behalf, inviting him or her to visit the Site. PuzzleNation stores your friend’s e-mail address for a short period of time for the sole purpose of sending this e-mail. We do not keep or use this information for any other purpose.

    The Information You Submit to Site Profiles and Forums

    You may choose to disclose information about yourself, including Personal Information, in your member profile or in the Site forums. Information that you disclose in these locations is public information, and there is no expectation of privacy or confidentiality. You should be aware that any Personal Information, or other information that may disclose your identity to others, that you post in these locations can be read, collected, or used by other members, and could be used to send you unsolicited messages. We are not responsible for any information you choose to post in these locations. Please see our Terms and Conditions on this point and for guidelines about Rules of Conduct for posting information.

    Note that members have the option of setting their profile preference to “private,” under which condition only the member’s PuzzleNation buddies may view their profile page.

    Affiliated and Third Party Sites

    If you click on a link to another site, including sites affiliated with PuzzleNation, you will leave PuzzleNation.com and go to the site you selected. You should consult the privacy policy of any site before providing any Personal Information, as even affiliate sites may collect different data, and store it differently, than PuzzleNation.com. We cannot control the activities of third parties and do not accept any responsibility for use of your Personal Information by such third parties.

    Editing Your Account Information

    You may change your e-mail address, your password, or your debit or credit card number at any time by making such changes on your “My Account” page at this Site (which you can only access if you are logged in).

    The PuzzleNation Mailing List

    We and our affiliates may occasionally contact people who have joined the PuzzleNation mailing list. Users who no longer wish to receive online promotional materials or e-mail newsletters from us or our partners may opt out of receiving these communications by clicking the unsubscribe link in any e-mail, or by e-mailing us a removal request at: customerservice@puzzlenation.com. Please allow up to four (4) weeks for removal of your name from our e-mail database for promotional or newsletter e-mails. We will still contact you by e-mail regarding issues specifically related to your membership account even after you have opted out.

    Governing Law and Jurisdiction

    Any disputes concerning this Privacy Policy will be governed by the laws of the State of Connecticut without regard to any principles of conflicts of law. The federal and state courts of the State of Connecticut will have exclusive jurisdiction over any claims arising out of or related to this Privacy Policy, except where it is otherwise expressly prohibited by statute. Solely by posting this Privacy Policy on our website, we do not intend to subject ourselves to the laws of jurisdictions outside of the State of Connecticut.

    Acceptance of Privacy Policy

    By using the Site, you are accepting the practices and consenting to the terms of this Privacy Policy and all Terms and Conditions of Use. We reserve the right to amend or modify this Privacy Policy at any time and will post such changes within this Privacy Policy. Your continued use of the Site will constitute your acceptance of the changes. If you do not consent to all of the terms of this Privacy Policy, you should immediately discontinue your use of this Site.
